CONTRACTUAL TERMS:

ORDERS:

1.    For placing the order use the tools, basket and the order module of this site.
2.    After having received the order it will be our care to send you a confirmation e-mail containing the ordered items, the availability of the goods, the weight, the total amount to be paid and the method of payment.
3.    Each order will be considered as valid ONLY AND EXCLUSIVELY after receiving  our approved order confirmation.

PRICES:

4.    The prices indicated on our price list are not binding, as a consequence we reserve the right of modifying them before accepting the order. Giulio Barbieri S.p.A will anyway undertake to keep valid the prices during the period of the contract (from the moment of order to the moment of delivery).
5.    The payment should be done within the terms reported on the order confirmation. Not observing the contractual terms will suspend the order without any obligation of prior communication.

DELIVERIES:

6.    The delivery terms indicated in the order confirmation are subject to the general validity.
Any delays, partial/total suspensions of the supply will not give right to pretend compensations. Anyway, after a certain period, the purchaser will be entitled to terminate the contract against the compensation of the down payment amount.
7.    In case of heavy strikes, difficulties in supplying the raw material, difficulty of transportation, wars, insurrections, interruptions of communication, redundancy, damages of the machines or other unpredictable events, we reserve ourselves the faculty to suspend the deliveries and to cancel the orders without entitling the purchaser to claim compensations.
8.    In is understood that the goods remain of our own property until the complete payment will be done.
9.     The transportation charge for each transaction will be calculated as shown in the order form.

NOT ACCEPTANCE:

9.    The purchased and photographed goods can suffer alterations of colour while compared to the colours of the screen and those from the photos. Thus, we do not accept complaints for the above mentioned.
10.    Possible complaints must be sent by registered letter WITHIN AND NOT LATER THAN 10 days from the date of goods arrival. For no reason the purchaser is allowed to return  the material without our prior written authorization. However, in this circumstance, we will only take in charge the delivery costs excluding and no further expense will be accepted.


OTHERS:

11.    Any dispute will be governed by the Court of Ferrara, interpreted in accordance with the European laws.

13.    The personal information provided by the Customer are protected by the law 196/2003  - dispositions regarding the protection of the persons  and other subject regarding the treatment of the personal data, which will be used during the validity of the contract.

PRIVACY:


Giulio Barbieri S.p.A communicates that the personal data provided with filling in of the registration module, request for information - questions, subscription to the mailing list or any other way, are subject to treatment of personal data - Legislative Decrete no.196/2003.

These data remain at ITS disposal for control, modification or cancelation and for exercising any other right foreseen by the articles 7,8,9 of Legislative Decrete dated 30 of June 2003.The User’s personal data will be kept in an archive from the moment of the first account registration

With reference to the User’s personal data and to the art 13 of Legislative Decrete 30 of June 2003 Giulio Barbieri S.p.A communicates that:

* The collection and the treatment of the personal data freely provided, filling in the forms, are necessary for acceding to certain services. A refusal has as consequence the impossibility to carry on the contract or having access to our services.
* The personal data will be treated in written form and electronic form. The data will be treated based on the contractual terms, including deposit operations, payment methods, and periodic delivery of information or promotion emails to the subscribed addresses in order to fulfil the obligations foreseen by the law or imposed by the Authorities
* The User’s personal data will be communicated to the employees of Giulio Barbieri S.p A.
* The User's personal data will not be disclosed to third parties but the ones indicated herein, excepting for the cases when other parties must be involved: banks for managing the payments, forwarding companies or other institutions which are carrying on activities that might be necessary in fulfilling the contractual terms.
